The minimum land area is allowed to separate into land plots in Binh Duong province

Binh Duong People's Committee issued the Decision No. 25/2017/QD-UBND stipulating the minimum area allowed to separate into land plots in Binh Duong province.  This Decision takes effect on October 10, 2017, and replaces Decision No. 38/2014/QD-UBND dated October 22, 2014, of the Binh Duong provincial People's Committee and Directive No.09/CT-UBND dated 28 March 2016 of Binh Duong provincial People's Committee.

This Decision basically retains the minimum area to be allowed to separate into land plots under the previous regulations. Specifically, the minimum land area to be allowed to separate land plots is 60m2 (for land area inward), 80m2 (for land area in town) and 100m2 (for land area in commune); The minimum area of ​​agricultural land to be allowed to be separated 300m2 (for land area inward), 500m2 (for land area in town) and 1.000m2 (for land area in commune).

The Decision regulates some new points on conditions for land separation. Accordingly, the area of ​a new land plot and the remaining after separation shall be greater than or equal to the minimum area of ​​each corresponding land category, after subtracting the area under the protection corridor of the public works in accordance with the Vietnamese law.

For residential land, the newly-formed land plots and the remaining after splitting must be contiguous to the roads managed by the State, ensuring a width and a minimum depth of 4m for land plots when contiguous with roads less than 20m, minimum 5m for land plots when contiguous with a road width of 20m or more. For the land of agricultural land, separation of land does not require contiguous roads.
