Decision No. 19/2018 /QD-TTg: The conditions for granting the certificate of hi-tech agricultural enterprises that enterprises in Binh Duong province should be noted.

The Prime Minister issued Decision No. 19/2018/QD-TTg regulating the criteria, competence, order, procedures for granting of hi-tech agricultural enterprises. High-tech agricultural enterprises are enterprises which fully satisfy the conditions specified in Clause 1, Article 19 of the Law on High Technology. The provincial People's Committee is the competent agency to grant hi-tech agricultural enterprise certificate to enterprises having registered their business in the province.

The Agriculture and Rural Development Department shall assume its responsibility for organizing the appraisal of dossiers of application for recognition of enterprises and submit them to provincial-level People's Committees for consideration and decision on the recognition of hi-tech agricultural enterprises. According to regulations, organizations and individuals shall compile dossiers of application for hi-tech application certificates sent by post or directly to the provincial Agriculture and Rural Development Department at the provincial level, in which the enterprise registers its business.

Within 5 working days after receiving the dossier, the provincial Agriculture and Rural Development Department shall have to check the completeness and validity of the dossier; To decide on the establishment of an appraisal team of dossiers of recognition of hi-tech enterprises for valid dossiers or notify in writing the enterprises of incomplete or invalid dossiers; The time for the enterprise to supplement or complete the dossiers shall not be counted in the appraisal time.

Within 7 working days after the establishment decision is issued, the appraisal team shall conduct a meeting to appraise the dossier when at least two-thirds of the members are present. The appraisal team shall evaluate dossiers compiled by the enterprises in terms of their completeness and accuracy, meet the prescribed conditions; Make minutes of the meeting and send it to the Agriculture and Rural Development Department at the provincial level.

Within 3 working days from the date of the meeting, on the basis of the results of the meeting of an appraisal team, the Agriculture and Rural Development Department at the provincial level shall submit to the provincial People's Committee for consideration and decision granting the agri-business technology application certificate. Within 03 working days from the date of receipt of the results from the Agriculture and Rural Development Department at provincial level, the provincial people's committees shall be responsible for deciding on the issuance of the certificate of high-tech agricultural enterprise and sending to enterprises, in case of refusal to grant certificates, must notify in writing the enterprises and clearly state the reasons therefor.
