Decree No. 81/2018/ND-CP: Detailing the Commercial Law on trade promotion activities that enterprises in Binh Duong province should be noted.
Decree No. 81/2018 / ND-CP of the Government promulgated clearly stipulating the maximum limit on the value of goods and services used for sales promotion and the maximum price level for goods and services promotion. Accordingly, the value of material used for sales promotion for a promoted unit of goods or services that are not entitled to exceed 50% of the price of such promoted goods or service unit before the sale promotion time, except for following forms: Organizing for customers to participate in cultural, art and entertainment programs and other events for promotion purposes; Provide sample, services for customers to try free of charge;
Offering goods or providing services without collecting money without accompanying goods purchase and sale or service provision; Selling goods and / or providing services, enclosed with the contestants' cards, for selecting winners according to the announced rules and prizes (or other competing forms and awards); Sales, service provision along with the attendance of programs of chance that participation in the program associated with the purchase of goods, services and winnings based on the luck of the participant as a whole prizes and awards (promotional offers of chance); Organize a regular customer program whereby rewarding a customer based on the number or value of purchase of goods or services that customers perform is expressed in the form of customer card, purchase goods, services or other forms. For cases of organizing concentrated promotion programs (hour, day, week, month, promotion season), the maximum value of goods and services used for sale promotion shall be 100%.
The maximum limit on the value of goods and services used for sale promotion shall also apply to promotional activities within the framework of programs and trade promotion activities decided by the Prime Minister. The Decree stipulates that the maximum discount rate for promoted goods and services must not exceed 50% of the price of such goods or services in advance of the promotion period. For cases of organizing sale promotion programs (hour, day, week, month, promotion season), the discount rate applicable to 100% of promoted goods and services shall be applied.
The maximum discount rate of 100% also applies to promotional activities within the framework of programs and trade promotion activities decided by the Prime Minister; The maximum discount rate for discounting goods and services shall not apply when implementing the price stabilization policy of the State, fresh foodstuffs; goods or services in cases where the enterprises to be bankrupt, dissolved, change of locations, business lines.
