Decree 149/2018 / ND-CP: Enterprises are responsible for publicizing the payment of social insurance, health insurance that enterprises in Binh Duong province should take notes  

The Government has issued Decree No. 149/2018/ND-CP detailing Clause 3, Article 63 of the 2012 Labor Code on the implementation of grassroots democracy regulations at workplaces. The contents of the employer must be publicized, including the performance of tasks, production, and business; Rules, regulations and other regulations of the enterprise related to the obligations, rights and legitimate interests of the employees; collective labor agreement of the enterprise, business lines collective labor agreement or other collective labor agreement which the enterprise participates in; resolutions of labor conferences; the deduction and use of the reward fund, the welfare fund and the funds contributed by the employees (if any); the payment of trade union fees, social insurance, health insurance and unemployment insurance; the situation of emulation, commendation and discipline, settlement of complaints and denunciations related to the lawful rights and interests of the employees.

 The employees are allowed to comment on the formulation, amendment, and supplement of rules, regulations and other regulations of the enterprise related to the obligations, rights and legitimate interests of the employees; To formulate, amend and supplement wage scales, payrolls and labor norms; Proposing collective bargaining content; To implement solutions to save costs, improve labor productivity, improve working conditions, protect the environment, prevent and fight fires and explosions; Other contents related to the rights and obligations of the employees according to the provisions of Vietnamese laws.

The employees can decide to enter into, agree to amend, supplement or terminate the labor contract according to the provisions of Vietnamese laws; to join or not to join the trade union grassroots organization; join or not participate in the strike in accordance with the provisions of Vietnamese laws; to vote on the content of collective bargaining achieved in accordance with the provisions of law; To vote on the contents of the resolution of the labor conference; other contents as prescribed by law.

The contents of employees subject to inspection and supervision include: performance of labor contracts and collective labor agreements; the implementation of internal labor regulations, regulations and other regulations of the enterprise related to the legitimate rights and interests of employees; the use of reward funds, welfare funds and funds contributed by employees; the deduction of trade union fees, social insurance, health insurance and unemployment insurance of employers; the performance of emulation, commendation and discipline, settlement of complaints and denunciations related to the lawful rights and interests of laborers; implementation of the resolution of the employee conference.

The decree regulates other forms of democratic implementation: internal information system; correspondence box; to make proposals, complaints, and denunciations according to the provisions of Vietnamese laws; other forms prescribed in the grassroots democracy regulations.

Employers are responsible for promulgating regulations on grassroots democracy at their workplaces so as to ensure the implementation of the provisions of this Decree. The grassroots democracy regulations must have the opinion of the labor collective representative organization at the grassroots and be publicized to employees before implementation.

The Decree takes effect from 1/1/2019.
