The Ministry of Labor, War Invalids and Social Affairs (MoLISA) is drafting a decree amending and supplementing a number of articles of the Decree No. 05/2015/ND-CP of the Government, dated January 12, 2015, detailing and guiding some contents of the 2012 Labor Code. The MoLISA proposes to supplement some contents of the labor contract in the direction of expanding the negotiation freedom between employers and employees.

Decree No. 81/2018 / ND-CP of the Government promulgated clearly stipulating the maximum limit on the value of goods and services used for sales promotion and the maximum price level for goods and services promotion.  Accordingly, the value of material used for sales promotion for a promoted unit of goods or services that are not entitled to exceed 50% of the price of such promoted goods or service unit before the sale promotion time, except for following forms: Organizing for customers to participate in cultural, art and entertainment programs and other events for promotion purposes; Provide sample, services for customers to try free of charge;

The Ministry of Planning and Investment has published draft law amendments, with some articles focusing on making the foreign capital flow more smoothly into investments and enterprises. The amendments, which are open for public consultation, propose the abolition of 67 conditional business lines specified in Investment Law 2014. If the draft law is approved, foreign investors will now be able to take a majority stake in or wholly own the Vietnamese business.

The Government has issued Decree No. 149/2018/ND-CP detailing Clause 3, Article 63 of the 2012 Labor Code on the implementation of grassroots democracy regulations at workplaces. The contents of the employer must be publicized, including the performance of tasks, production, and business; Rules, regulations and other regulations of the enterprise related to the obligations, rights and legitimate interests of the employees; collective labor agreement of the enterprise, business lines collective labor agreement or other collective labor agreement which the enterprise participates in; resolutions of labor conferences; the deduction and use of the reward fund, the welfare fund and the funds contributed by the employees (if any); the payment of trade union fees, social insurance, health insurance and unemployment insurance; the situation of emulation, commendation and discipline, settlement of complaints and denunciations related to the lawful rights and interests of the employees.

The Government entrusted the Ministry of Planning and Investment (MPI) to draft a law to foster revisions of business regulations in the future. MPI’s Deputy Minister Đặng Huy Đông talks to Vietnam News Agency reporter Quốc Huy about related developments.
